These Terms govern your use of Construct-it (“the Service”), provided by Construct-it Technologies Pty Ltd (ABN: to be confirmed) (“we”, “us”). By signing up, you agree to be bound by these Terms.
The Service offers a 14-day free trial with no credit card required. To continue after the trial ends, add a card before it expires and you will be charged according to your selected plan (Start / Pro / Premium). If no card is added, your account simply pauses. You may cancel anytime from Control Panel → Billing.
Refunds: monthly plans are non-refundable for partial months. Annual plans are refundable on a pro-rata basis within 30 days of payment.

You own your data. We act as a data processor on your behalf. You are responsible for ensuring the accuracy of project, claim, variation and retention information you enter. We provide the math; you sign off the numbers.
When you connect Xero, you authorise Construct-it to read invoices, contacts and bank transactions, and (with your explicit per-action confirmation) to create ACCREC invoices in your Xero organisation. We do not modify or delete existing Xero records. Each post is logged to the audit log.
Construct-it generates progress claim documents that include statutory notice text where required. This is general boilerplate, not legal advice. You are responsible for ensuring your claims meet the requirements of the applicable Security of Payment Act (e.g. BIF Act QLD, BCISP NSW, SoP Act VIC). Consult a construction lawyer for material claims.
We aim for 99.5% monthly uptime. We do not guarantee uninterrupted service and will not be liable for outages caused by third-party providers (Vercel, Supabase, Xero, Stripe).
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability for failing to comply with such a guarantee can be limited, our liability is limited (at our option) to re-supplying the Service or paying the cost of having it re-supplied.
To the extent permitted by Australian law, our total liability for any claim arising under these Terms is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages.
You may cancel any time. We may suspend or terminate your account if you breach these Terms or fail to pay. On termination, your data is preserved for 60 days then soft-deleted (audit logs and accounting records retained 7 years as required by AU tax law).
These Terms are governed by the laws of Queensland, Australia. Any dispute shall be resolved in the courts of Queensland.
